Class Action – Sam hereI have done a cursory look into how class action suits emerge. I do not vouch for the absolute veracity of the following, but it does appear to be close to the way these things work. It seems that one or more (normally up to three) wronged shareholders will file the suit, with one of the firms that specialize in this type of litigation. For a finite amount of time, other firms will attempt to become the ones who get to file. They will try to attract more deserving complainants than those listed by the firm which “started” the other suit(s). Finally, one firm, and its determined-to-be most deserving named complainants, will emerge as winning the right to bring the suit. Here’s the interesting part, to me. Even if the suit is wildly successful, the lead complainants are really the only shareholders who end up with significant remuneration. All other shareholders normally receive a pittance – the lion’s share goes to the firm and the small number of initial named litigants. It appears that this is the carrot that causes some shareholder(s) to put themselves forward as the originating complainants – they realize if they do not do so, they will not recoup much in the way of their losses, while some very few others will be quite more successful, in their stead. If a suit does materialize, it will be interesting to see who (if any) will emerge from our little family of IV investors as the chosen ones. Class Actions - Sam hereMy, admittedly sideline, experience with class action suits is thus: Law firms appear to solicit investors to join their class action suit. Principal complainants seem to be investors with large investments in the company, and the hoi polloi are invited to join their suit. Probably a lot more to this, however, the part that seems to always stay the same is (if the suit succeeds) the lawyers get rich, the main complainants get well (and sometimes even better than well if they share in some sort of penalty assessment) and the hoi polloi get peanuts. The rallying cry to join the lawsuit, is countered by investors knowing that their reward will be slim, which is subsequently countered by the lawyers asserting that getting something back is better than nothing. In my humble assessment, we and the company get screwed. I would be very grateful if those more knowledgeable about class actions would better describe the process of class action suits. sam
Re: full of sound and fury.- Sam here>>our interests as shareholders are still probably best served by not filing a derivative suit against him right now. Such a suit will be even more bad news for VirnetX when it can ill afford more bad news<< IMHO, there will be some form of Class Action, even though it will not be in our best interests. I'm thinking Apple will not miss the opp to punish VHC by convincing some disgusted individual(s) to initiate one. sam |
