1° This is a commercial patent dispute between two private parties. The Confidential Information contains and/or reflects information that Teva has designated as “Highly Confidential.”

2° Particularly, the Confidential Information discloses Teva’s proprietary, competitively sensitive, and technical information and highly sensitive business information, including but not limited to, nonpublic proprietary information relating to Teva’s ANDA. This information is regarded as highly proprietary and kept confidential, and is not otherwise disseminated to the public.

3° The Confidential Information relates to information that Teva considers confidential and proprietary information.

4° Counsel for Teva has submitted a declaration stating that Teva has an interest in not publicly disclosing this information and relies on such information to advance its business strategies.
